The Paper Experts Inc. User Agreement

Effective January 1, 2004.

This User Agreement ("Agreement") is made by and between The Paper Experts Inc., a Canadian corporation, ("ThePaperExperts.com") and you ("you"). This Agreement contains the terms and conditions that govern your use of this Web Site.

By ordering from our web site, accessing or using any part of this web site, you agree that you have read, understand and agree to be bound by this agreement. If you do not agree to be bound by this agreement, do not access or use any part of this web site.

ThePaperExperts.com reserves the right to make changes to this agreement at any time. Continued use of any part of this web site constitutes your acceptance of such changes. Accordingly, you should read this entire agreement to understand it fully.

1. Definitions

1.1 "ThePaperExperts.com Service" means all of the services that ThePaperExperts.com offers, including but not limited to the "Custom Writing Service" and the "Prewritten Service," and all the technology, processes, and materials used to provide these services.

1.2 "ThePaperExperts.com Web Site" means the web site located at the domain names "ThePaperExperts.com" and also relates to all our sister websites listed in our links page and at such other domain names used to identify web sites on which ThePaperExperts.com may offer the ThePaperExperts.com Service.

2. General Rules

2.1 You will comply with all of the terms and conditions of this Agreement and all applicable laws, regulations and rules when you use the ThePaperExperts.com Service, whether you just browse the ThePaperExperts.com Web Site or order one of our services.

2.2 ThePaperExperts.com will only provide the ThePaperExperts.com Service to persons and entities that can form legally binding contracts under applicable law. Without limiting the foregoing, minors may not use the ThePaperExperts.com Service without proper parental consent.

2.4 If ThePaperExperts.com determines, in its sole and absolute discretion, that you will breach a term or condition of this Agreement by submitting a paper you purchase from us as your own, ThePaperExperts.com may cancel any order for such Service without any liability to you or any third party.

3. Your Conduct

3.1 Generally, you must use the ThePaperExperts.com Service in a manner that demonstrates good taste and respect for the rights of ThePaperExperts.com and third parties.

3.2 You will not collect any information from the "Whois" database information or anywhere on this site to (i) use "spam," "blast-faxes", (ii) interfere with the ThePaperExperts.com Service by using viruses or any other programs or technology designed to disrupt or damage any software or hardware, (iii) use a robot, spider or other device or process to monitor the activity on or copy pages from the ThePaperExperts.com Web Site, (iv) collect electronic mail addresses or other information from third parties by using the ThePaperExperts.com Service, (v) impersonate another person or entity, (vi) engage in any activity that interferes with any third party's ability to use or enjoy the ThePaperExperts.com Service or (vii) assist any third party in engaging in any activity prohibited by this Agreement.

4. Intellectual Property Rights

4.1 ThePaperExperts.com will solely and exclusively own all property that is deemed intellectual in nature. This property includes but is not limited only to: our graphics, text, links, order forms, advertisements, our writer's names and addresses, database design and everything involved in how our website works and our processes.

5. Disclaimers, Exclusions and Limitations

5.1 ThePaperExperts.com will write any document according to the requirements given. However, when information is requested and it is not fully explained and we can't contact you for any reason you agree that we can write your document according to our best judgment. We will revise your work if a writer agrees that we have left something out but given the subjectivity of this business we reserve the right for the writer to be the final judge if a revision is required.

5.2 You agree to use our services and products for research purposes only. This means that you will only use our products and services as a guide or model to write your very own document unless you order our essay editing service or application editing service.

5.3 ThePaperExperts.com remains the sole owner and copyright holder of the model document you have purchased. You guarantee that you will not submit any part of our model paper as your own without properly referencing it in your bibliography. You also assert that you will respect all copyright of our document by not uploading it, giving it to someone else, reselling it, or in anyway allowing someone else other than yourself to use it or possess a copy of it. You also verify that purchasing products or services from our web site is legal in your country, state, province, city, or town.

5.4 ThePaperExperts.com will not be liable for any consequences that occur due to the use of our products and services. We ask that you always read your document carefully. You are the ultimate judge of our service, not anyone else at a later date. You determine if you want a revision on your paper and what needs to be revised, not your professor or an educator at a later time.

5.5 ThePaperExperts.com will not be liable to you or any third party for any consequential, incidental, indirect, punitive or special damages (including damages relating to lost profits, lost data or loss of goodwill) arising out of, relating to or connected with the use of the ThePaperExperts.com service, based on any cause of action, even if advised of the possibility of such damages.

5.6 ThePaperExperts.com will not be liable for the use of any products from any advertisers, affiliates or partner sites that you may wish to purchase. We ask that you carefully read their terms of use before making any purchase.

5.7 Indemnification. You will indemnify and hold ThePaperExperts.com and its employees, representatives, agents, affiliates, directors, officers, managers and shareholders (the "Indemnified Parties") harmless from any damage, loss, cost or expense (including without limitation, attorneys' fees and costs) incurred in connection with any third-party claim, demand or action ("Claim") brought against any of the Indemnified Parties insofar as such Claim alleges facts or circumstances that would constitute a breach of any provision of this Agreement by you. If you are obligated to provide indemnification hereunder, ThePaperExperts.com may, in its sole and absolute discretion, control the disposition of any Claim at your sole cost and expense. Without limitation of the foregoing, you will not settle, compromise or in any other manner dispose of any Claim without the consent of ThePaperExperts.com.

5.8 You will pay for Products in accordance with ThePaperExperts.com's Payment Methods policy.

5.9 If you order Products, you do so in accordance with ThePaperExperts.com's Ordering Policy. ThePaperExperts.com will ship Products in accordance with ThePaperExperts.com's Shipping policies.
